FUNCTIONS NOT TO BE THE RESPONSIBIITY OF THE EXECUTIVE AND LOCAL CHOICE FUNCTIONS

Functions not to be the Responsibility of the Executive

In accordance with Regulation 2 of the Local Authorities (Functions and Responsibilities) (England) Regulations 2000 (the Regulations) certain functions must be determined by Council and cannot be the responsibility of the Executive.  Many of them are delegated to a committee of Council or a council officer.

The list of functions together with the relevant statutory provision is set out in Schedule 1 of the Regulations.

Local Choice Functions

 

What are local choice functions?

 

The law specifies which functions are the responsibility of the Council, which are the responsibility of the Executive (Cabinet), and which may (but need not) be the responsibility of the Executive (Local Choice functions). All other functions not specified are the responsibility of the Executive.

 

Local choice functions are set out in Schedule 2 to the Regulation. These functions may be, but need not be, the responsibility of the council’s executive. It is up to each council to decide. Having regard to government guidance, Full Council has decided that local choice functions will be executive or non executive as set out in the table below.
